Regulations of CARGO by OWEE Online Shop

1. CARGO by OWEE Online Shop, operating at http://www.cargobyowee.com, is an ICT sales platform conducted by Anna Migacz Lesińska, running her business under the name MIGFACTORY Anna Migacz Lesińska, with the seat at Prokuratorska 1/1, 02-074 Warsaw, registered in the Central Registration and Information on Economic Activity conducted by the Minister of Economy, VAT ID 7342572648, hereinafter referred to as "CARGO by OWEE".

2. The terms used in these Regulations shall mean:

1. Online Shop – a shop operating at http://www.cargobyowee.com in which its users can via the internet purchase products offered by CARGO by OWEE;

2. Customer - a natural person, legal person or an organizational unit without legal personality, while having the capacity to perform legal acts, which under the terms of these Regulations register or purchases in the Online Shop without registration;

3. Working Days - all days of the week from Monday to Friday, excluding public holidays;

4. Order Implementation Time - the time in which the order placed by the customer should be completed and sent to the address at which the order should be executed. Delivery time needed for the carrier should be added to the order implementation time;

5. Online Shop Database- a database containing data on the performance of the transactions and the goods that are offered in the Online Shop. The database also shops data on customers using the Online Shop for the implementation of the orders placed by them.

6. Cart - part of an Online Shop, through which the customer specifies the order details such as: number of products, delivery address, billing information, shipping method, payment method, and other data, if their release is required in connection with the order.

7. Goods – products presented in the Online Shop

8. Product Page – a website in the Online Shop, which shows information about the product;

9. CARGO by OWEE salon –a traditional retailer point of sale located in CARGO by OWEE Showroom, address: Prokuratorska 1/1, 02-574 Warsaw, email: buy@cargobyowee.com

§ 1. General provisions

1. The Regulations define the rules for using the Online Shop CARGO by OWEE, placing orders for products available in the Online Shop CARGO by OWEE, delivering the ordered products to the Customer, paying by the Customer the sales price for the products and presenting the Customer rights.


2. Customers can get access to these Regulations at any time through the link found on the main site http://www.cargobyowee.com, download it and print it. »Saving, securing, and sharing data concerning the order and the Regulations on selling the Goods (general terms of the contract) takes place via e-mail.

3. To use the Online shop, including browsing the products of the Online Shop CARGO by OWEE, as well as to place the order for the Goods, it is required to have:
- a computer with access to the Internet and web browser, such as Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Safari;

- an active e-mail account (e-mail).

- install Adobe Flash Player and enable JavaScript, CSS frames and styles; 4. The user of the Online Shop is forbidden to deliver illegal contents and use the Online Shop in a manner oppressive to CARGO by OWEE and other customers. 5. Content provided through the Web Site contain materials protected by law, including copyright and industrial property law, in particular: trademarks and works. Also the arrangement and selection of the content presented on the Websites is an autonomous object of protection under Polish law, including, in particular, basing on the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2006 No. 90, item 631, as amended.), the Act of 21 July 2001 on the protection of databases (Journal of Laws No. 128, item 1402, as amended.) and the Act of 30 June 2000 on Industrial Property Law (Journal of Laws of 2003 No. 119, item 1117 as amended).
§ 2. Registration and logging in

1. The condition for making purchases in the Online Shop may be registration.

2. In order to register, visit http:// www.cargobyowee.com, select "Register" and fill out the registration form with the following details: e-mail, password, first name, last name, phone, street, house/flat number, zip code, city, date of birth, address for correspondence (optional), name of the company and VAT ID (to register as a company)

3. To register you have to read and accept these Regulations, as well as consent to the processing by CARGO by OWEE of personal data necessary for the implementation of the orders placed in the Online Shop, and to delegate the processing of these data to the entity referred to in § 10 section 4.

4. After completing the registration form it is necessary to use the link hidden under the "Register" button.

5. After the activities referred to in section 4, CARGO by OWEE will send to an e-mail address provided on the registration form a message containing a link, which is a confirmation of your registration and finishes the registration procedure.

6. After registration, the Customer may log in to the Online Shop by using the data provided during the registration: e-mail address as the user name and a password.

7. After logging in the Customer under "My Data" may, by completing the form, fill in his/her details providing the address, shipping address, and optionally a company information. Also in "My Data" the Customer may change the data and the password.

8. In order to remove the Customer's account at an Online Shop, please send an email to buy@cargobyowee.com requesting deletion of the account, together with the e-mail address currently registered in the Online Shop.
§ 3 Ordering by a Customer having the status of a registered Shop user

1. A registered Customer can place orders for products available at the Online Shop via the website http://www.cargobyowee.com twenty four hours a day every day of the year, whereas the orders are implemented on weekdays.

2. A Customer after signing up and logging in, places an order, selecting at the product Website the product of his/her interest, by using a hidden link under the field "Add to Cart" and then in the Cart indicates the reception and payment method for the order. To do this, the Customer should follow the onscreen prompts and the information available on the site.

3. In the order (in the Cart) the Customer indicates:

a) goods ordered and the size of the product, if the product offered is in different sizes;

b) address to which the goods are to be delivered;

c) method of delivery;

d) method of payment.

4. During the order process, until pressing "Order", the customer has the possibility to modify the data entered and in the selection of the Goods.

5. After entering by the Customer of the Online Shop all the necessary data, a summary of the order will be displayed.

6. In order to send the order it is necessary to accept the Regulations and click the button "Order".

7. In accordance with the Regulations sending of an order is a declaration of intention to conclude a sale contract with CARGO by OWEE.

8. The contract shall be treated as concluded from the moment of entering the Customer order to the order system of the Online Shop, provided the order complies with the Regulations.

9. After the conclusion of the contract, the Customer receives an e-mail entitled the ORDER which contains the confirmation of all the essential elements of the Order.
§ 4 Orders placed by a Customer who does not have the status of a registered Shop user

1. The unregistered customer can place orders for products available from Online Shop via the website http://www.cargobyowee.com twenty four hours a day every day of the year, while the implementation of orders will take place on weekdays.

2. In order to conclude a sale contract via an Online Shop, go to http://www.cargobyowee.com, choose the Goods, their colour, size, etc. To do this, follow the onscreen prompts and the information displayed to the Customer on the site.

3. The selection of Goods ordered by the Customer is made by adding them to the Cart.

4. During the order process, until pressing "Order", the customer has the possibility to modify the data entered and in the selection of the Goods.

5. After entering by the Customer of the Online Shop all the necessary data, a summary of the order will be displayed. The summary of the order will contain the following information:

a) the object of the order

b) the unit price and the total price for the ordered products and services, including delivery costs

c) the chosen method of payment

d) the selected method of delivery

e) delivery time

6. In order to send the order it is necessary to accept the Regulations, provide personal information marked as mandatory, and press "Order".

7. In accordance with the Regulations sending of an order is a declaration of intention to conclude a sale contract with CARGO by OWEE.

8. The contract shall be treated as concluded from the moment of receiving the Customer’s order in the Online Shop computer system, provided the order complies with the Regulations.

9. After the conclusion of the contract, the Customer receives an e-mail entitled the ORDER containing the confirmation of all the essential elements of the Order.
§ 5. Prices of goods

1. The Online Shop publishes information on its offer on the http://www.cargobyowee.com and offers goods from the database of the Online Shop via the Internet.

2. Prices on the Online Shop website included with the product offered on the product Website:

a) contain all duties, fees and taxes, including VAT, and are shown in Polish zloty;

b) do not contain information on shipping costs. Delivery costs depend on the method of delivery of the product to the Customer, on the value and size of the order and are provided while choosing the method of delivery of the product by the Customer.

3. The binding and final price of the product is the price indicated on the product website at the time of the order by the Customer.

4. Information on the total contract value including the shipping costs, is presented on webpage http://www.cargobyowee.com, after the Customer's choice of method of delivery of the order and the payment mode (see § 5).

5. CARGO by OWEE reserves the right to make changes in the prices of goods on offer, including price promotions. The right referred to in the preceding sentence shall not affect the orders made before the date of entry into force of the change in the price, the promotion or bargain sales and will be executed on the present basis.
§ 6. Methods of payment and delivery

1. Payment for the ordered products can be made:

a) in cash in the case of supply of the order through a shipping company or other entity providing shipping or while picking up the order at the CARGO by OWEE Salon;

b) by payment card in one of the electronic payment systems in the CARGO by OWEE Salon;

c) by electronic transfer;

d) by an ordinary transfer to a bank account.

2. CARGO by OWEE will enable electronic payment for products ordered through the system offered by PayPal and payU.

3. In Poland the objects of the order can be delivered through the Polish Post or courier at the address indicated by the Customer or received by the Customer in the CARGO by OWEE Salon. a) delivery by courier service - up to 3 days; b) delivery by the Polish Post - up to 5 days.

4. The current price list of supplies is available in the Online Shop at http://www.cargobyowee.com. In addition, the cost of delivery will be indicated when ordering.

5. Delivery of ordered goods takes place in the territory of the Republic of Poland.

6. In the case what the Customer would like his/her order to be delivered outside the Republic of Poland, the Customer should contact the following address: buy@cargobyowee.com or by phone at the number: +48 794 347 928 to arrange an individual order, including in particular the cost of delivery of the products covered by this order.
§ 7. The implementation of the orders

1. Implementation of the order shall be construed the delivery of the ordered products to the Customer.

2. Subject to section 5, the Order Implementation Time for goods ordered in the Online Shop is not more than 9 working days, excluding the time of delivery. The deadline for delivery of the Goods shall run from the date of dispatch to the Customer of the confirmation of the order.

3. If the Customer chooses payment option other than "COD" or in cash at the time of receipt, in the absence of payment for the order within 21 days from the date of its submission, the transaction will be considered invalid and will be automatically cancelled.

4. In cases where it is not possible to process the order due to temporary inability, CARGO by OWEE shall propose a different service corresponding to the same quality and purpose, and for the same price, while informing the Customer of his right to refuse this service and to withdraw from the contract by returning products at the expense of CARGO by OWEE.
5. In the case of foreign shipments the Order Implementation Time may be extended.
§ 8. Terms of complaint

1. Complaints can be submitted to the address of CARGO by OWEE Showroom, address: Prokuratorska 1/1, 02-74 Warsaw, or the address indicated in the Contact information.

2. To facilitate the identification of the User as well as the requests and demands, it is recommended that the complaint sets out:

a) the Customer's data enabling contact with him and identification, including the e-mail address and telephone number,

b) the Goods to which the complaint relates,

c) the charges made by the Customer,

d) the grounds for the Customer’s complaint,

e) Customer’s proposal for the possible way of settling the complaint or eliminating the alleged infringement.


3. The complaint referred to above should be submitted within two months from detection by the applicant the circumstances giving rise to the complaint.

4. CARGO by OWEE undertakes to respond to the complaint within 14 days of its receipt.
§ 9. Withdrawal from the contract

1. According to the Act of 2 March 2000 on the protection of consumer rights and liability for damage caused by a dangerous product, the Customer may within 14 days from the date of delivery cancel the purchase of goods purchased in the Online Shop (withdraw from the contract without giving any reason) .

2. In order to take advantage of the powers referred to in section 1, one must draw up and send to CARGO by OWEE at the address of CARGO by OWEE Showroom, Prokuratorska 1/1, 02-074 Warsaw, an appropriate written statement of withdrawal from the contract. A sample of such a statement is available in the Online Shop at: http://cargobyowee.com/oswiadczenie

3. The fact that CARGO by OWEE presents a sample of the statement of withdrawal from the contract referred to in section 2, in no way obliges the Customer, if he intends to withdraw from the contract, to lodge a statement with the content provided in the sample. The sample is only an example of a statement which the Customer can be guided by while lodging a declaration of withdrawal from the contract.

4. To preserve the 14 day period referred to in section 1, it is enough to send a statement of withdrawal from the contract within this time.

5. In the event of withdrawal from the contract, the contract shall be considered null and void, and the Customer is exempt from any obligations. What the parties provided is returned unchanged unless a change was necessary in the ordinary course of business. The return of what has been provided shall be effected without delay, not later than within fourteen days. If the Customer has made any advance payments, they are due with statutory interest from the date of prepayment.
§ 10. Final provisions

1. CARGO by OWEE reserves the right to discontinue the provision of services by blocking User Account, whose deliberate actions will violate generally applicable laws, the rights of third parties (including, in particular intangible property rights), personal rights of others, the rules of social intercourse or the provisions of these Regulations. Customer will be notified about the intention to block the account by a message sent to the email address currently registered in the Online Shop. Resumption of provision of services by unlocking the User account is subject to the CARGO by OWEE decision. Cessation of services does not affect the performance of the contracts concluded by the Seller and the Customer, whose User's account has been blocked.

2. The Customer should inform about the irregularities related to the functioning of the Online Shop to the e-mail address buy@cargobyowee.com or phone +48 794 347 928. CARGO by OWEE undertakes to consider the complaint within 14 days.

3. All matters not covered in these Regulations shall be governed by common law, and in particular the Civil Code and the Act on the specific conditions of consumer sale and the provisions amending the Civil Code (Journal of Laws No. 141 of 2002, item 1176) and the Law on the protection of certain consumers rights and on liability for damage caused by dangerous products (Journal of Laws No. 22 of 2000, item 271).

4. The Online Shop may for an important reason change these Regulations with prior notification of the Customer about such decision. If within seven (7) days of notification of the Customer about changes in the Regulations the Customer does not remove his/her Account, then CARGO by OWEE assumes hat the changes have been accepted by the Customer. As an important cause of changes in the Regulations shall be considered, in particular: amending laws, loss of privileges required to offer individual services in the Online Shop, loss of rights to the domain, or a significant hardware failure.

5. In the case of amendments to the Regulations, the orders placed before the date of the modification to the Regulations shall be implemented on the basis of the rules in force before the introduction of the change.

6. The Regulations is in force as of October 1, 2013
